What is Alternative Dispute Resolution (ADR)?

Alternative Dispute Resolution (ADR) encompasses methods of resolving disputes without resorting to traditional courtroom litigation. It is referred to as “alternative” because litigation has traditionally been the dominant form of resolving conflicts. Recognized formally by the Civil Procedure Rules (CPR) in 1998, ADR has deep historical roots, dating back to 1066 in England. In those times, citizens often established temporary court-like structures to address disputes outside the King’s Court, with some resolutions earning the King’s approval as binding decisions.

ADR employs various techniques that do not require disputing parties to appear in court. Common methods include Mediation, Arbitration, Negotiation, and Customary Arbitration. However, these are not exhaustive, as ADR encompasses other approaches not classified as major methods.

In Ghana, the application of ADR is limited in scope. It cannot be used to address matters involving public interest, environmental issues, constitutional interpretation, or any matter expressly excluded by law. ADR may be initiated voluntarily, either through predispute contract agreements (ADR ex ante) or by mutual consent after a dispute arises (ADR ex post). It can also be mandated by a predispute contractual obligation, court rule, or referral.
